Khalid Sheikh Mohammed, alleged mastermind of the Sept. 11, 2001, terrorist attacks, and four others accused in the attacks will be put on criminal trial in New York, Attorney General Eric Holder is expected to announce later Friday.

While I never approved of the use of torture on prisoners or the kangaroo court rules that the Bush Administration put in place for the enemy combatant trials, I can't understand how these guys can be tried in civil court instead of military court. Weren't they all apprehended outside of the US? They should have always been tried under regular military court rules. Given all of the issues related to their capture and imprisonment these trials will be tied up in appeals for DECADES.

I just watched the Holder news conference. When pressed twice about what will happen with the five accused should they be found not guilty, Herr Holder replied that he is confident, confident the government will win it's case. He is "confident". Relax everyone . He is confident, therefore, there is no cause for concern. I take this as a guarantee from Holder, don't you? At least we will know whom to tar and feather should they get off.
BTW, conservative estimates are the trial won't begin for about five years and will last about six months. Are the libruls appeased? No, of course not.

Well, in any trial, even a military trial, even the show trials that Bush wanted, there is the theoretical possibility of an acquittal...that's how living under the rule of law works.

But, I still dont' see the wisdom of taking this out of the regular military court system, minus the Bush tinkering, and putting it in civilian court where the defendants have MANY more rights, especially in terms of appeals, this will undoubtedly end up in the supreme court eventually, after a couple of decades.

If a courtroom trial was good enough to convict people like McVeigh and Nichols, then why shouldn't it be good enough for Khalid Sheikh Mohammed? If anything might have weakened the case the government can make against him, it would be the unlawful practices the Bush administration followed in torturing him and denying other basic rights during his detention in Guantanamo.

The Bush administration's detention and torture policies have caused the unnecessary complication of criminal cases against people like KSM. That's just ONE reason not to have done it in the first place, aside from the moral question. I know that alot of War on Terror zealots think it's silly to give any basic rights to detainees, but you can't have it both ways. You can't claim to be a beacon of freedom while violating other peoples' human rights. Giving KSM a fair trial is the price we pay for being a decent and fair country, no matter how distatesful it might be to wing nuts.

What is complicating the matter is that a large portion of the evidence was gotten through information-gathering methods that a) have proven to be unusually effective, b) are still providing good information on other terrorists currently active, and c) work so well and continue to work so well because terrorists don't know what they are.

In a military tribunal, that's not a problem, since the method of information gathering can be held in confidence. In a civilian court, it is a certainty, because the method can be challenged as well as the evidence.

You really should have thought before you supported this, Bob. Or maybe that was the point of you and Barack "God damn America" Obama; a civilian trial would be a sure-fire way to get all intelligence tactics used against terrorists aired and exposed, making it that much easier for your Hamas, al-Qaeda, and Hizbollah friends to develop effective countermeasures.
