However much anyone dislikes Scalia, you can't compare him to Sotomayer or Thomas or even Miers, he is undeniably qualified to be on the Supreme Court.

I predict she will turn out just like Thomas..never deviate from the standard liberal view, won't ask questions and won't write any major opinions. I guess we could say that the court is now balanced out by a totally unqualified, intellectual light weight on the left to go with the one on the right. Sad.

Let's all just "Pray" that no one else retires in the next 3 1/2 years.

It is not a racial matter in either of these two. Obama is half black and if he was doing good for this country it would be different. His race has nothing to do with his ability to govern this country. He is just not qualified to do so. If he was not such a socialist and so egotistical it would be a different matter. There are a lot of black folks that have good sense about them. There are a lot of Latino's that have good sense.

On balance, I would prefer that Sotomayor be confirmed. her abrasive personal manners and her lack of eloquence will be much preferable to a far brighter leftie like Cass Sunstein or Kathleen Sullivan. As Beldar said a while back, if the Messiah had appointed Sunstein, within six months he would be leading Anthony Kennedy around on a leash.

So, exactly what part of top grades and law review at an Ivy League suggest dumb? No, I am not talking "C"s like legacy W got. I am talking "A"s. And all grading is anonymous. So which of Sotomayor's opinions did any critics actually read to come to the opinion that Sotomayor is anything less than brilliant? Um, none. Whereas almost all lawyers who have ACTUALLY READ her opinions, she is a very, very good writer and legal analyst. And this hitjob comes from Riehlworld, a website that worships someone who can't cite a ONE single itsy bitsy Supreme Court case!
But Sotomayor is a latina, so the rightwing world can say that about her because of its underlying belief that affirmative action lets dumb people rise to the top. You have no data, no real world examples and no specific evidence but if you keep saying it enough times, it must be true. And you get to do it because racism and misogyny is okay in the rightwing media and blogging world.

Really? If so, then how do you assign grades to people, if you don't know what work is theirs?
Answer: By skin color. Leftists like Wally Sandaver believe that Latinos and blacks should receive extra bonus points for skin color and that, if not enough blacks pass a test, the test is automatically racist and should be thrown out.

There is no consensus anywhere that Sotomayor is a "brilliant" jurist or that she's a great writer, in fact, as far as I can tell, nothing in Rosen's piece has been found to be false. She certainly did not impress me as "brilliant" or particularly insightful or articulate.
As far as real world examples of less qualified people getting jobs/promotions/admission to schools on the basis of affirmative action, they are all around you....they are in the Ricci case, crystal clear, they are in the bus drivers I see in my own city who CANNOT SPEAK English, they are in the sullen, incompetant government workers I encounter, they are in graduation rates and testing data.
She may be more qualified than Thomas, but that isn't saying much.

John Cunningham makes a VERY good point.
Better a mediocre liberal jurist who will more or less keep to her own counsel... than an out-an-out totalitarian socialist and judicial activist like Cass Sunstein who'd much more easily sway the centrist justices with his arguments.

I agree, on balance, Sotomayor won't be much different than Souter and there is a very, very slight chance that she will be a bit tougher on criminal defendants than he was, but its hard for me to believe that Obama would appoint anyone who wasn't in truth a doctrinaire liberal.
Like I keep saying, pray that Kennedy hangs on, if he retires, we're finished as a country, there will be no undoing the damage that another 30 or 40 years of a liberal court will do.
Look at the horriifc damage the Warren court did in its short time.
