Sotomayor was wrong, according to toda's Court. Unfortunately, the four libs came down on her side. SO this won't be the disqualifier some might like to have. Be sure to wish Kennedy a long and happy life in your prayers today.
In a 5-4 ruling authored by Justice Anthony Kennedy, the U.S. Supreme Court has reversed the ruling by Supreme Court Nominee Sonia Sotomayor and two other Court of Appeals judges in the case of Ricci v. DeStefano. [Full opinion and analysis below]
In Ricci, white New Haven firefighters claimed that they were the victims of discrimination. The City of New Haven had utilized a racially-neutral officer qualifying exam, prepared by a company which specializes in firefighting tests, specifically designed to avoid inherent or implicit biases which might discriminate against minorities.


But wait, there's more! It was not a cut & dried 5-to-4 decision. The 4 dissenting judges STILL thought that Sotomayor and her liberal activist colleagues were wrong:
"Judge Sotomayor thought it appropriate to use an unpublished summary order to dispose of the claims of the New Haven firefighters in Ricci v. DeStefano. Today the Supreme Court issued 93 pages of opinions in the case that Sotomayor acted to bury.
Further, although there is a sharp 5-4 divide among the justices, not a single justice ( http://bench.nationalreview.com/post/?q=OTBhOTEzMTZhMmMyNDczNTE5MjA4MTI0Mjk1Zjc5MDA= )thought that Judge Sotomayor acted correctly in granting summary judgment for the City of New Haven."
One would have to be an imbecile to believe that Sotomayor belongs on the Supreme Court.

I find this quote hilarious because, for a brief moment, I almost think Mr Roth knows what "granting summary judgment" means.

I'd still LOVE to see that test becaus I can't imagine how anyone could create a biased leiutenant test for any fire department.....unless of course they are allowing unqualified candidates to test in the first place.
