What I'm unsure of is, did Obama nominate her out of simple incompetence? Or does he wish to preserve his anti-American sentiments in government for as long as he can, while trying to lock up hispanics for 2010?
There are also a few jarring elements that contrast to the pedagogical approach. First, I'm curious as to when Sotomayor ceased being a Puerto Rican nationalist who favors independence -- as she says she does in the preface. (The position, as she points out in the thesis, had received 0.6 percent in a 1967 referendum, the most recent such vote before she wrote the thesis.) I don't know that I've seen it reported anywhere that she favored Puerto Rican independence, which has always been very much a fringe position....
Second, her unwillingness to call the Congress the U.S. Congress is bizarre -- in the thesis, it's always referred to as either the 'North American Congress' or the 'mainland Congress.' I guess by the language of her thesis, it should be said that she's seeking an appointment to the North American Supreme Court, subject to advice and consent of the North American Senate. This kind of rhetoric was very trendy, and not uncommon, among the Latin Americanist fringe of the academy.


It shows that she's a radical, refusing to call the U.S. Congress the U.S. Congress is RIDICULOUS.
Radicals don't belong on the supreme court. Not of any stripe.
But she will get confirmed, whether she's more radical left than Ginsberg is probably doubtful. Me, I think this trend of tit for tat, replacing a woman with a woman, a black with a black is quite negative, rather than enhance diversity and race blindness it turns everything into a quota with a score card about how many of "our" people did we get in....very troubling over the long term.
The real issue for the future of the country is whether Stevens can or will or wants to hold out another 4 or 8 years to be replaced by a possibly more conservative justice or whether he's going to want Obama to appoint his replacement.

Llama, Bush 41 almost certainly nominated her because a New York Senator asked him to--that's generally how it works. Circuit Judges don't get SC level scrutiny and it doesn't advance the argument much to claim otherwise. Also, I have to categorize your claim that Riehl criticizes this nomination on the grounds that she is Puerto Rican as dishonest. It's just too obvious that that's not what he's doing.
What's the advantage of referring to the "mainland congress"? Is her position that congress does not wield authority over any unattahced land? Cause I think they do. But SFAIK, Puerto Rican independence is favored by close to a third of the island so it's not fringe and so long as she supports legal means of acheiving it, that shouldn't count against her. IMO.
The thing that bothers me (other than the racism that too many people seem willing to paper over) is the La Raza membership. You can't support breaking off a third of the country and giving it to someone else by legal means--there are no legal means. Any Supreme Court justice should recognize the legitimacy of U.S. Sovereignty. That seems like a minimum qualification because without it, she cannot take the oath of office, she cannot fulfill her duties.

Judge Sotomayor’s comment in her speech at Princeton University's Third World Center in 1996 that:
“…For example, in Spanish we do not have adjectives. A noun is described with a preposition…”
is absolutely remarkable for its lack of understanding of grammar. One can only hope that her grasp of the elements of American jurisprudence is not as faulty. Other than that, I wonder if she has outgrown her leftist references of the US Congress with all their implications. She may turn out to be just another one trick pony.
