FWIW - a lot, I hope. A new comment on my Matt Nicholson post. Nicholson is a soldier in between tours in Iraq. He was charged for intervening in a domestic dispute at the urging of a young boy whose Mother was allegedly being beaten.
I last posted the above on Sept. 12, 2007. Since then an attorney volunteered her services to help Nicholson with these charges made by the Oakdale PD. Shortly thereafter a decision was made within my private investigations company to provide free investigative services as well. My partner, retired sheriff's deputy Louis Galindez signed on to handle the criminal investigation. We reviewed the police reports and as expected, they were lacking in several areas to mount this type of prosecution. Our investigation was done over the weekend, and the results had us all scratching our heads. Why was this arrest made? Nicholson wasn't a threat to anyone except the guy beating his wife and strangling his mother-in-law. Why didn't the PD refer this case to the DA's Office for review? Apparently, the Oakdale PD and the wife beater saw Nicholson as a threat to the community, when the opposite should have been assumed. Also, the wife beater has a history of domestic violence. This arrest has sent the wrong message to anyone thinking about rendering aid. Be careful in Oakdale, CA.
Today, the attorney representing Nicholson has told us that our DA's Office in Modesto, will be dismissing the charges against Nicholson this Friday. Cooler heads have prevailed and once again our DA's Office ran by DA Birgit Fladager has made the right decision in this case. Now, the soldier Nicholson can continue fighting for his country and representing the USA.

Some people in Modesto really stepped up for this Soldier. You can find an account of the help of strangers here http://www.modbee.com/local/v-print/story/65777.html. In addition to Mr. Joven, Mr. Nicholson's attorney volunteered, and bail was raised by people in the community.
Thanks for highlighting this story--I think it was instrumental in getting the situation straightened out for Mr. Nicholson. And thanks Mr, Joven for the assistance you provided!

In the 60-70's an American soldier was safer in Vietnam than in the United States. It has progressed to the same thing, at least in Ca, for the Iraq Vets. Twenty years from not the United States will not exist, the democrats will have turned it over to some dictator or got it destroyed by their cowardance.

Dan,I just happend to come upon this site by accident, I amazed at what a great article you had wrote about my son, what you said I wish thats what was posted in The Modesto Bee.Your story is the closest to the facts, great job. I would like to tell everyone who supported my son in this awfull situaition that my family and I are so gratefull to each and everyone of you, the people who posted his bail, the bail bonds men, his attorney ,a gentlemen by the name of Victor, who is truley a god send to Matthew. Victor who our family never heard of before called me when he saw Matthew on the news, he did some follow up and wow things started rolling in the right direction for Matthew. victor wanted to do something for my son, and this man raised money to throw a big BBQ on Sunday for Matthew, as well as getting him a plane ticket back to Fort Cambell Ky. Matthew forfitted his ticket as he was in jail, and the ticket was non-refundable. I'm not sure if people know this or not but soliders get very little pay, and they have to buy there own tickets to fly home on, as well as there uniforms and other things they need. They are though however provided with weapons to fight in a war.Yes they get free housing on base, and food if they go down to the mess hall, to me that isent enough for these soliders who go put their life on the line to protect us from the terrorist who threaten us everyday. I have not been seen in the media or at Matthews court, advised for my own interst, I might be sitting in jail now if I had been in the court room the first two times.I know alot more to the story as to why that idiot didnt go to jail, but I'm not to discuss it.Oh but I will when Matthew is gone back over to Iraq and this is behind him. You can bet your last dollar on that. Seeing my son in skackles and hand cuffs on the news, is not what any mother wants to see. Lemas knows as well as about 90% of the citizen's of Stanislaus County that he should have his ass sitting in jail. The arresting officer as well as Judge Stone should be there as well, sounds like a crooked cop and judge to me.Thought that just happend back in the back woods, and on tv, guess not. Carillo and Stone should get canned for the horroiable job they did. I guess by that statement you can see why I didnt go to court or talk to the media. I'm so disgusted with Carillo's police work, he knew Lemas was a known spousal abuser and he still took that child back in the home. What was he thinking, he has 4 children of his own, I guess he wasent thinking. Carillo and I are going to have words, I am a officers wife and I have respect for the men and women in law inforcement, who took a oath to lay down there own life for the citizens, even a scumb bag. Carillo's police work is what gives cops a bad name. I have been wanting to get that off my chest. Anyways thank you for keeping it real Dan, on your post good work.
