In a nutshell, the case exploded when an intelligence officer dropped a bombshell on prosecutors during a pre-hearing interview when he revealed the existence of exculpatory evidence that appears to have been obtained by the Naval Criminal Investigative Service (NCIS) and withheld from the prosecutors.

It's important to note that this is the case Jack I'll shaft the troops Murtha pre-judged, calling the Marines murderers at the time.

I think the wingers are in for another in a long line of disappointments. First they said there was nothing at all to Haditha, it was all made up by the terrorists and their media partners. Then the military investigation concluded charges should be brought. Generally, when someone is offered IMMUNITY it means they have committed a crime, which is why they need IMMUNITY. It may be that the military is trying to separate those with less culpability who may have stood by and done nothing or helped cover it up and those who actually participated in the alleged killing of unarmed civilians. But of course, to the wingers, further and further divorced from reality every day...the idea that someone is granted immunity from criminal prosecution in return for their testimony means there was no crime committed. And so it goes.

I honestly don't think there is a single element of American jurisprudence or American government that the wingers understand.

The presumption of innocence is for the judge and jury. It doesn't prevent anyone, me, you or Jack Murtha from deciding on guilt or innocence at any time.

I am 100% convinced that Brian Nichols is a mass murderer. I would not be allowed to serve on his jury because I feel there is zero doubt as to his innocence. He is still entitled to a defense and a trial with the burden of proof resting on the prosecution.

I am also free to make determinations about what happened at Haditha based on what I know of the facts, or not. It would be shocking indeed for the military to bring demonstrably innocent soldiers to trial for a civilian massacre. Thus, logically, there is strong evidence of their guilt. Whether this evidence is contradicted or can be explained away in the heat of battle or not will be decided at trial.

I remember when news broke of the gang rape of the Iraqi girl by American soldiers, and many on Dan's blog suspected the girl was a prostitute and that's why the house was known to the soldiers. This is how wingers think. They prefer a completely irrational explanation, rather than the facts. Any fool who read the charging documents and the detailed confessions could see they were guilty of gang rape and murder.
