That's the word, though I'd let this one play out, owing to any possible issues with the 16 yr-old special education student.
However it does look like the police did their homework ... along with everyone else in this case.

March 7, 2007 -- A beautiful blond music teacher has been busted for allegedly having a torrid affair with an underage special-ed student.
Emily Streb, 23, was arraigned yesterday on third-degree rape and other charges at Bronx Criminal Court for allegedly having sex with a 16-year-old, whose name is being withheld because of the nature of the charge.
"The complaining witness is a special-ed student who suffers from psychiatric problems," Assistant DA Heather Cook told Judge Ralph Fabrizio. "She was his music teacher."


Wonder if theri is proof beyond the accusation?

Hard, you are right on. I know a guy fresh out of college who landed a job in his old high school. Ten years ago he was charged with sexual assault on a student. Charges were dropped when the student admitted she was lying. This guys reputation was shot, he will never again work as a teacher.
Considering this students back round, his mental illness if you will and that of his so called mother, you do have to wonder.

What I don't wash well with is the lowering of the age of consent ... by consensus?
Last time I checked (in most US jurisdictions) the age of consent was 18. It may not make much difference in that the boy is __physically__ capable of fathering a child, or just have sex. And then the fact that he is a "special needs" child (or minor, if we must flabble about what age range constitutes "childhood") only compounds it.
Perhaps a re-evaluation of our age of consent laws vis-a-vis the UK is in order: from what I understand, 15 is the age of consent pretty much all the way around.
The thing that wrinkles the silk sheets there is, one person may appear passably (sp) as a full-grown adult at age 15, while another person of the same age has yet to grow hair downstairs.
How does one make a law that governs the wide range of latitude that can exist in 15-18 year old age range...?
The best we can do, I think, is to keep the thing that works.
But for all the "prostitots" - that is, kids of 13-16 years of age actively hooking up, this speaks of a lapse in parental guidance. I fear for the generation born in the 70s and 80s in particular, being raised in that most narcissitic age of the 90s and coming of child-rearing age themselves now.
What matter of lawlessness will our lack of even knowing how to properly discipline our children bring?

I work with a lot of young people. The other day in a converstation with a young woman that is turning 18 this week, I asked her what freedom she whould find in turning 18. She told me she could date anyone she wanted, no matter their age, she could get a tattoo, and body piercings.
At 17 she has lived with a parent on welfare, one that cares more about spending money on beer and take out food.
This week a few of us gathered and made SURE Sam has her senior prom gown and all the fixings. I hope her mother objects......then I can lay into her ass.

I always urge people to wait until the case plays out in court and a jury gets to decide if the defendant is guilty or innocent. I would also suggest that no matter what the age of consent may be it should always be illegal for a teacher or other school employee to have sex with a student, a matter of position of power and authority. If this case is brought to trial and she's convicted I sincerely hope that she gets put in jail for a long time and not merely given a slap on the wrist because she's young and attractive.

If the boy was mentally able to consent then she shouldn't go to jail, not a big fan of statutory rape statutes being employed in cases where both parties agree everything was consensual leading to jail time for the older person.
She should never be allowed to teach again and any teacher who does have sex with their student, be it 15 or 17.5, should never be allowed to teach again.

I suppose it would be fairer to wait for more info on this case. Two things, though. One, "having special needs" nowadays can mean anything from needing an iron lung to breath to being traumatized by a jack-o-lantern last Halloween and needing a hug. Two, having been 16 for one year myself once, I have quite a bit of trouble seeing this 16-year-old as a victim. I should have been such a victim. Agree w/yyy though about teachers who seduce or whatever with students shouldn't be teachers any longer.

I was 16 in the wrong era, man! I personally think most 16 year olds are fully capable of consenting to sex as anyone else. The vast majority of 16 year old boy's lives would be vastly improved by a nice 23 year old piece of tail. Now, just because the young man was a special education student, let's not leap to the conclusion that he is a full-on retard. That would be wrong if he is. But if he's got an IQ of at least say, 100, I'm fine with it.
But, then again, from a point of fairness, a man who had sex with a 16 year old student would get crucified, so it is fair for her to get in trouble as well.

I too know this girl. She worked her ass off to become a teacher, and has only just begun her career. From what I know, she's not stupid and uses good judgement. She's always been more than responsible. For that reason, I say innocent til proven guilty. If she is found guilty, then justice should be served but considering her character, I'd say not likely.

I also knew her pretty well, I pray that it is not true both for her sake and most important the student. The students in D75 have enough issues and often come from homes where there is a history of abuse. But it is odd that she resigned so quickly. And no matter what age, consent or not it is NEVER appropiate for a student and teacher to be involved and any teacher should know that.

This really seems silly to me. 16 is the age of consent in 30 states out of 50 states and the District of Columbia. If he'd been there or been a year older (17 is the age of consent in New York State), this wouldn't even have been a crime, and she would only have lost her job. It really does seem more like the mother who felt violated here, not the kid.

I know Emily. I have for 23 years. She worked hard in school, she was involved in a lot of activities,community service, and athletics. After she graduated she went on to Hartwick (not an easy school to get into)to pursue a degree in Music Education. Bright, beautiful and full of life until now. As far as being a slut, so be it! It doesn't mean she did this. On the flip side, special ed doesn't mean retarded. I know special ed kids that are labeled that just because they need more time to take tests!! Hang in there Emily. I actually teach at the same school as Emily, and I know that she did do it. She was repeatedly told to dress more appropriately and was seen several times doing a "come hither" dance to the child. It was actually another teacher who caught her naked with this child in her Bronx apartment. I also know the student, and these students aren't "mildly" special, this is a school for severely emotionally disturbed children. He's not lying.

I've been waiting for this story to hit. I know someone who worked with "Streb" and even met her once myself and it was a bit strange to see someone who seemed to relate everything back to sex. This saddens me for the student's sake. The fact that these students are severely emotionally and psychologically disturbed makes her behavior with them even more predatory. These young men don't need whatever Streb was offering them. The week before she was charged- and who knows how long prior- she was supposedly working as an escort! I think Emily deserves the benefit of doubt. When working in a close environment with any human being for a long period of time things can get blurred. I would highly doubt that this girl just "abused" this person against his will. It probably started out as a game of sorts and Emily was transported back to the innocent years when sexual relationships were new and meaningful. She went with her feelings and got involved oops.
