Men who live as women can now legally use women's rest rooms in New York's transit system under an unprecedented deal revealed yesterday.The Metropolitan Transportation Authority agreed to allow riders to use MTA rest rooms "consistent with their gender expression," the Transgender Legal Defense and Education Fund announced yesterday.
Ace notes that the NJ Supremo's did leave it to the Democratic process, what's left of it, to name Gay Marriage. lol That's so freaking silly, as if it needs another name. But I suppose we could call it the Homo-Cohabitation Bill, or would bill be sexist?
Volokh points out that the slippery slope argument seems to have prevailed, despite the great wisdom of the liberal editorializer's.

As I said initially, what's troubling here is that a handful of unelected individuals believe they have the Constitutional right to make law when that was never intended by the framers. Yes, it is because our legislators have abdicated their responsibilities that we find ourselves in this position on all too many issues. That shouldn't be lost in the debate.
But courts all over the country have shown their fondness for stepping into that vacuum and something has to be done to stop that trend. The people are being removed from the so-called democratic process more and more everyday and it needs to stop.

Everyone is talking about gay marriage, gay rights, and if they're not talking about it, they're listening to all the news channels talking endlessly about it. The blogs are rocking with the issue as are most of the states of our union. Is Dan just supposed to abstain so he won't insult tender sensitivities? As if he does in the first place? Get a grip. As far as transgenders using ladies rooms, I'm sure it bothers guys far more than gals. So what? I mean... so what? You want them in your mens' room while you have your tiny wanker in your hand?

There are contradictory statements: 'The legislators are abdicating their responsibilities' vs. "courts all over the country have shown their fondness for stepping into that vacuum ". Which came first? Sounds as if the legislators created the vacuum, and if that's the case, I wouldn't call the courts stepping in to fill it a 'fondness'. More like they have no choice sometimes. But no doubt it all has to be fixed.

seriously, you guys should be happy about the courts stepping in- you never would have gotten your Premier Bush without them! so you gotta take the good with the bad. as far as i can tell, gay marriage and transgendered bathrooms are a small price to pay for the awesome achievements of President Bush.

I swear, I honestly think if we piled up a bunch of people from both parties, we'd find more agreement on this issue than disagreement. This stupid political divisiveness is creating an impenetrable fog over human nature, and it's to the detriment of our country. The imperatives of human nature too often take a backseat to politics, and that sucks.
