How can you have a negotiation when one party lacks the ability to say no? Hmmm?
The District will begin using eminent domain to acquire parcels of land at the site of the Washington Nationals' ballpark by the end of this month, after unsuccessful negotiations with nearly half of the landowners.
City officials said they expect to file court documents to take over at least some of the 21-acre site in the coming weeks and have $97 million set aside to buy the properties and help landowners relocate.
The city made offers to all 23 landowners on the site last month but received no response from 10. "We think there are some that we'll have good-faith negotiations with," said Steve Green, director of development in the office of the Deputy Mayor for Planning and Economic Development.
"There are some we haven't heard from at all."

Alamo, this kind of thing has been going on for awhile now, a survey company a friend worked for, did a lot of the work @ Florida Disney World during its development, which now, most of its property is sitting on indian burial grounds.

Actually, that was a state or local event then, and if it was not for highways or military installations--then it was illegal as well.
And that too, is Un-constitutional. There is are some words, that have either totally disappeared in many cases, or are totally ignored. Those words are, due process. Due process means that the defendent is either a criminal, in which case his/her property may be taken, or the land sits on a proposed highway, or is the prospective site of a fort, or military installation.
Anything else, is not even a court case, the landowner has 100% all other rights--at least he did....in America.
There is nothing that gives the state, or the feds the right to take property for anything other than forts, or government highways.
When you see it for private business, then explain to me the difference between that and Germany in 1933-1945. There is absolutely no difference.

An addendum:
In the case of military installations and/or or highways, JUST compensation is also given. With this new crap, your compensation is...."too bad."
(also third sentence should have said "There are some words...") I am not really that dumb!
