dan, i am still underwhelmed...that being said...your post about the group think of allowing the president to have his pick when we agree with him and fighting him when we don't did make me think. since there are so many qualified females, on the bench, with a wonderful thorough knowledge of constitutional law...this just upsets me because i look at Roberts and i was expecting an equally qualified female...totally up for the job. if that meant a good fight...so be it. in the end, i think what has everyone upset is the fact that, with the war in iraq, the hurricane and the looming cloud of a legacy which may not read as would have been desired, those of us who have effected the president's second term, essentially feel that he has "totally whimped out on us". so this begs the questions, is the president wearing out? is he no longer up for the fight? has his ideology changed? what do you guys think explains this debacle of an appointment? in the end...what terrifies me is that i have realized that i have become more of a conservative than i ever could have imagined on a personal note, but what also terrifies me is that i never thought i would witness the president's base arguing against his nomination. you have to give it to him...he is never a boring president.

Fair enough, Cathy - but as I posted a while back, I think the President feels he knows the heart of his nomination - and also knows the person. Politics can change, even positions. People tend to not change - which is why I think he went for a "person," he knew, as opposed to someone's record. Fact is, Stevens, Bryar and others had great conservatiob "records," no one knew them as people, and they drifted left.
You talk of legacy and the fact is, if Miers proves to be a solid constructionalist - his legacy could be better than Reagan's 20 years from now because of his influence. You suggest Bush isn't up for the fight. I think he's more concerned with winning it, than fighting it.
