Kalpoe Lawyer Threatens Beth Holloway With Lawsuit

Elgin Zeppenfeldt, an attorney for Satish Kalpoe, accused Beth Holloway Twitty of making "prejudicial, inflammatory, libelous and totally outrageous" statements.

"She called our client, Mr. Satish Kalpoe, a 'criminal,' 'involved in a violent crime against my daughter' and who is 'allowed to walk freely among the tourists and citizens,' " Zeppenfeldt said in a statement issued Wednesday afternoon.

Well, it's a good thing that the family of Natalee Holloway has a lawyer of their own to respond.

Asked whether there would be an apology for Twitty's comments, attorney Vinda de Sousa told CNN: "I plan to speak with the family tomorrow, and that could be one of the options I might suggest."

Posturing like the above from the Kalpoe attorney is starting to work on my last objective nerve and my advice for Ms. Holloway would likely not be as judicious.

Funny, I see no comment from the lawyer for Deepak Kalpoe - I wonder if his client is feeling a just a bit more guilty.

As regards Satish, isn't it at least fair to conclude that, based upon what we do know ... he is a conniving liar that manufactured a story thereby obstructing, in the prosecutor's words, a murder investigation?

If I'm not mistaken we have a word for that in the United States .... it's criminal. I'd be interested in knowing the exact nature of the grounds for any lawsuit on behalf of this conniving, lying alleged criminal by American judicial standards, otherwise identified here as the still suspect, Satish Kalpoe.

Zeppenfeldt said his client also resents Twitty's insinuation that he might leave the country, and "resents her plea to other nations not to give him a safe haven, as he does not intend to leave the island."

Twitty, the attorney said, has "publicly acted as judge, jury and executioner."

Executioner? Hmmm. Let me look that up.

One who executes, especially one who puts a condemned person to death.

Good heavens, Ms. Twitty better call an attorney ... I think someone just went on record with CNN caling her a murderer!

First, I'm pretty sure that the "judge, jury, and executioner" comment was figurative. Obviously he wasn't saying that Twitty held a trial, decided the case, and killed Satish.

Second, Satish's lawyer certainly has a strong defamation case against Twitty. First, no one's claimed that Satish has committed a crime under Aruban law. Obstruction of justice is a crime in the US, but what are the requirements for one to be guilty of it? I'm sure you don't know, and I'm sure you can't show that Satish has satisfied all the elements. Also, it's not clear whether it's a crime in Aruba. And if it were, wouldn't he be facing charges? Therefore, Twitty made a false accusation that Satish was a criminal when she had no facts to back it up.

There's an even stronger argument for defamation though, that you overlook. You focus on the "criminal" comment, but you forget that Twitty said that Satish was "involved in a violent crime against" Natalee. This is completely without basis in fact.

Now all you need to seal a defamation lawsuit is proved damages. I don't think Satish will have much of a problem showing that Twitty's remarks tend to damage his reputation significantly.

Before you think with your emotions, sit on the sidelines and think about what this lawyer said. A claim for defamation has a good chance of being successful here.

I do believe the Holloways know much more than they can say for whatever reason that is but you know, nobody made the Kalpoe brothers apologize when they lied about where they left natalee and caused two innocent men to go to jail. My point isn't to argue the law. The fact is he lied about facts pertinent to the investigation of a woman's missing daughter. That we DO know.

My point is about class, character, humanity - anything you want to call it. I really don't care about the "law" in this specific matter being addressed. From the point of "social" commentary, this lawsuit nonsense makes them all look like hideous animals.

The lies of these boys as much as anything else de-railed this entire investigation, put the wrong people in jail and likely could have led to the destruction or deterioration of evidence.

A judge might enjoy arguing the fine points of the law around this. A man might just step up and call a slimey degenerate just that and throttle the little cretin and his lawyer for their inhumanity, if nothing else.

The future for Satish is already likely Zero as it is. And not because of damage to his reputation by the statements of another. His lawyer's posturing, if it continues, will all but assure that - if it hasn't already been determined by fate. My best guess is he has no idea what can of worms he opened up with his initial lies.

The way things are going this will end in no justice for anyone invloved. But all involved will pay, perhaps more dearly than they realize just now.

None of you know who is guilty and who is innocent in this case. Beth and family do not know either. All we really know is that Natalee is missing and that Joran and the brothers initially lied about what happened, which created suspicion. The lie could have been an indication of guilt, or it could have been because of another reason coming from as yet underdeveloped teenage minds.

Frankly, I think, if Joran and the brothers had said that the brothers dropped off Joran and Natalee on the beach and then Joran said they had sex and he left because he had school the next day, all three would never have been arested; just my judgement.

I would say that Beth needs to go home to recover her balance. After the court hearing for the appeals this coming Friday or Monday, this case is going to be old news. Nothing is likely to happen, baring an unlikely discovery of a body, and the press is is going to go home. Beth and family will not be asked for interviews and they need to regain some stability from returning to familiar surroundings and familiar routines.

Maybe the family will get lucky and some new break will happen, but they can do little more at this point other than alienate the Aruban authorities.

Granted, the investigation is still under way to determine if it was a murder, or not. But what Dan said has substance whether a murder has been proven yet or not.

Obstruction of justice is a crime in and of itself, not an extension of another crime. Whether it's referred to in the Dutch legal system still seems to be a mystery at this point. All Dutch legal experts I've seen answering that question have stated that it MAY not be law under the Dutch system. If it is in fact recognized as part of the Dutch legal code, then there will not need to be a another crime established prior to the charge of obstruction of justice. Anyone have a definate answer as to whether obstruction of justice positively is or is not regarded under Dutch law?

So, if it is recognized under Dutch law, then the Kalpoe brothers, as well as PVDS, and Steve Croes could be charged with obstruction of justice, whether or not another crime has been established yet.

If it is not recognized as law, it is still considered by the judge(s) when making their decisions on whether or not to detain a suspect for further questioning. So, in essence, even if it's not in the law, it could affect any of the remaining suspects now or in the future.

No matter what, you gotta admit, it's just not a good idea to obstruct justice; i.e impede an investigation. It makes you look like a criminal! And it can have consequences during the legal process, whether or not a prior crime has been established. It's a no, no...but unfortuneately will probably not end up having any other consequences than a slap on the wrist.

Actually, under the Dutch legal system, suspects apparently have less rights than under the American system. Suspects can be detained (or arrested as you say) for questioning, up to 116 days I believe, without being charged of a crime. But you knew that already :)

Please explain the premature maneuvers that judges have to contend with. So far, the prosecution, the defense, and local LE have admitted that the process seems to be proceeding as it should to the letter of the Dutch law. I don't think we'll hear any complaints from the judge(s), so we may never know if they feel they are having to contend with any premature maneuvers. Could you be a bit more specific on what these 'premature maneuvers' are? And the way in which these so called 'premature maneuvers' are affecting the judge(s) in a negative way? Is that another wrinkle in the Dutch legal system that just hasn't been explained to everyone yet?

* On a side note, I tend to agree with Dan that the obvious humanity, or lack thereof, when making idle threats of a defamation lawsuit is absolutely appalling, especially considering the suit is coming from a suspect who has acted in a criminal manner by impeding an investigation, and with what appears to be no remorse for a missing, innocent girl. I would have to question whether suspects in a current case are allowed to pursue a defamation of character case right in the middle of a time sensitive investigation anyways. I would think that they would have to wait until the investigation ended....

I think that the Kalpoe's lawyer is trying to take the focus off of his client. It's ridiculous that all of a sudden there are protests against Beth and Jug. Here's the net effect of the this new story... the lawyer "demands" BHT apologize, and she say's f-you, and here's why I think they're not innocent little boys who are entitled to soft glove treatment. The "here's what we know these cops know about the Kalpoes" ... the only issue that might forestall that is whether it queers the case. At this point, they should assume that she's not living, and press the local goofballs for progress.

The world really is watching, or enough of them, to affect this country's reputation and economy. I know I'm affected, and I spend 5K a week on virtually any vacation I take. The key is if they are suspects, not if they are the last seen with the missing girl. In the case of Natalee Holloway, the last 3 people seen with her should have been suspects from the very beginning, and therefore detained and questioned and had evidence collected from them.

I would stress that they should have been suspects and detained on day 1, not on day 11. These suspects (all 3 still are confirmed suspects, the currently released Kalpoe's and the currently detained JVDS) just so happen to be the last 3 people seen with NH.

The key word is suspects. The fact that they are the last 3 seen with her is only a contributing factor of their being labled as suspects, but not the definitive factor in detaining them.

The sooner a person can be established as a suspect the better, as they can be detained, and prevented from destroying, hiding, or falsifying evidence. In the case of NH, the 3 current suspects should have, and could have, been detained during day 1 of the investigation, rather than day 11.

To sum things up, suspects should be detained if there is a possibility that it will aid in the collection of evidence to help in solving a case of a missing person. If the last people seen with a missing person happen to be a suspect, then yes, they should be detained if possible, until they are cleared. That is one thing that is true in both Dutch and American law.

If the Kalpoe's and JVDS were detained in the beginning (on day 1) it would have greatly aided in solving this case. If they are innocent, it would have aided the suspects, and they surely would have all been cleared by now. They are actually their own worst enemy in this case. By their actions, they suggest guilt.

BHT is right on to keep pressure on all suspects. I do see however, under her own legal counsel, I presume, she is changing tactics. Interviews BHT has given the last few days indicates they are going with the Kidnap theory. Mind you, they don't believe this, but with no body as PVDS says "no body, no crime" However if BHT lawyers charge kidnapping, they already have incriminating evidence such as lies by the Kalpoes, Lies by JVDS, the drugging of the drink, the confessions of "She kind of stumbling around at the beach" The confession of having sex, the comment "Something bad happened" I believe BHT has been informed by authorities that Natalee is probably dead, an no body will be recovered. So she has shifted gears onto the kidnapping theory in order to glean at least some justice. AFter all the boy admitted to being with her and then leaving her on the beach.

Now onto PVDS for a minute, has any one considered that he didn't pick up JVDS at 4am at the fast food resturant, but it was the other way around? JVDS and NH on the beach. It goes bad, he calls papa. Papa gets him and takes him home and then calls Police cheif friend. They dispose of NH body in dumpster. PC friend drops off dad and he walks to fast food resturant. He calls JVDS to pick him up. In the process he wakes up JVDS from sleep at 3:30am. JVDS sees he has a text message from Kalpoe while on the way to pick up dad, responds that he got home alright. Picks up dad, returns home. PVDS tells him not to worry, that NH wasn't there, probably wandered off, will probably show at crack house. JVDS then tells dad that Kalpoe brothers were around. PVDS confers with Police Cheif friend and then changes story again and says lets get the boys together and make up story about Holiday Inn. Plan to frame secruity guards is hatched. Kalpoe brother calls DJ friend to back story up in case JVDS and dad double cross them.

BHT is worried that JVDS will be released on technicality. By goind with kidnap theory, they at least glean some justice.

BTW, reports of a ransom note are either not credible or perhaps someone trying to cash in on someone elses misery.

About Beth's statements, I clearly understand they come from a deeply hurt person and I think everybody should forgive her for them. If evidence shows later that the Kalpoe's are innocent I am sure that Beth Holloway will not speak like criminals about them anymore. I think the Kalpoe lawyer should take a step back and just wait until the case is resolved.

I also ask everybody to stop bashing Aruba. What happened with the NH case in Aruba is a first. The people are in shock and will also need to grieve over NH after all the facts are out there. About the difference in time mentioned by Paul vdS. He told the police he picked up Joran at 11 pm from MacDonalds. He told them this the night when the Holloways and police entered the house of vdS, at 3 am.
The people that were also there, but standing further away than the police, thought they heard PvdS say he picked up Joran at 4 am or 4.30 am. This difference in time was the reason why PvdS was arrested.
In the interview with Dutch tv he explained this.
