The Terry Schiavo issue seems to have more than a few people on either side riled up just now, as witnessed by this going on at Ace's HQ and Jeff at Protein Wisdom's post reacting to HundredPercenter's link dump post and what started in the comments area there.
And now I find I have my own bone to pick with someone over their comment on Beth's blog,

similar to comments this Hectorvex made in the HundredPercenter thread, making it, at best, a pathetic troll for attention. But at whose expense?

Yeah, when a conservative disagrees with you, he kicks your ass. Problem is, Mikey, on some principles we may even be in agreement. But it isn't about con or lib, decent people don't go puke on someones blog who chose to become very involved in the issue, especially to gloat about anyone's death under any circumstances. That's what fucking idiots and fascists do ... ass hat.
Now congress is involved. That was the wrong move. Although it was only to grant permission for the family to take their case to federal court. Really, this case never should have left the courts in Clearwater, Jeb should never have gotten involved and this thing should have ended years ago.
Then you know next to nothing about the case, and less about the constitution. The Congress is specifically responsible for conferring the jurisdiction of the courts, wing nut. Get it? THEY get to decide where that jurisdiction should reside and not you, me, or some state judge. None of the above is constitutionally empowered to question it. That's why even a constructionist (hint: they don't build houses) can at least find an argument with what happened.
Their right to empower jurisdiction was usurped by a state court without a thorough review. And save any nonsense about "it went to the Supreme Court," because this issue was never raised. And courts cannot reach out and create out of whole cloth the issues they will undertake as regards a case before them. The incompetence here ran from the state court level through the legal teams involved. And even if it was ultimately resolved as it wound up, that would at least have been constitutional and due process on Terry's behalf.
The local news said it best last night, the people that are most outraged about her right and choice to die are those of us who know nothing about the case. We're not there - the bloggers are not there.

How can we aspire to make that kind of decision for her? What makes us Gods that we can go crazy on the Internet about her right to live and how Michael Schiavo is evil and on and on. We've got nothing. She has a right to live, but made it clear years ago that now she would like to carry out her right to die. Why can't we grant her that?
Do you know who David Boies is? Robert Bork? Mark Levin? to name just a few? Lawyers, excellent lawyers who have read the full trial transcripts and said that, above all else, there is less support in the trial record for that presumption than any other issue in this case. And if it were a criminal case, there is no way the ruling should have gone as it did, as the original trial judge's determinations of fact were poorly supported around that issue.
I would have argued granting Terry her wishes whatever they were as far as a right to die. The fact is, they were never established beyond reasonable doubt in the minds of many excellent lawyers who read the trial transcripts. If dumb is your blog shtick, you should get a fucking webbie.
Essentially, I don't want Terri to die. It's just the reality of it is that she'd be better off that way - and you know it. Go ahead an argue that point but she's been a veggie for so long, any life she could possibly live is gone. Any life those around her could possibly live is fading fast.

This is why there are STATEs rights and FEDERAL rights and 3 branches of gov't. Thank god the sane court system tempered the fantical rights insane desire to overstep their own boundries and mess in a STATE case.

Your post has reached new levels of confusion and ignorance, even for a lefty. State's Rights is a dead issue in this country and has been for a long, long time. The 10th Amendment has NO teeth , and the 14th Amendment made the Bill of Rights applicable to the states. Period. It's amazing to witness a lefty finding common cause with a redneck.
Anything the Federal government finds objectionable in the states can be overturned or overruled, and practically all of it has a precedent. Conservatives have been fighting this for years, and your remark about the "insane right" reveals where your sympathies and cynicism lies. You're late to the party and you didn't bring a bottle.
Had the court wanted, it could probably have found a penumbra in the fucking Commerce Clause to give Schiavo a right to a de novo hearing. Money changes hands in the hospice doesn't it? You don't seem to know much about the Civil Rights case, do you? States' Rights my ass.
Full Faith and Credit almost always renders rights defined in one state defensible in all the others, such as gay marriage. What do you think of that, genius? The issue with Terri Schiavo was the right of due process, and the right to a de novo hearing, nothing more. Had the de novo hearing ruled that she be disconnected, the issue would have ended there.
